OÖ Touristik GmbH takes the protection of your personal data very seriously. This includes any information relating to an identified or identifiable natural person. Your data will only be processed on a legal or contractual basis, on the basis of your consent or in the context of a legitimate interest for specific, defined purposes (Art. 6 DSGVO).

1. Contact/enquiries

You have the option to ask questions through our website or by phone. The information you provide (such as your email address, name, telephone number, interests) is exclusively used to process your request.

2. Newsletter
You have the option of subscribing to newsletters on our website. For this purpose, we will need your email address and your consent to receive newsletters. After subscribing to the newsletter, we will send you a confirmation email with a link, to confirm your subscription (double opt-in).

The personal data you provide (email address, optionally interest: salutation, first and last name) will be stored and automatically processed for this purpose. This data will only be processed for sending the newsletter. In addition the website uses Web Extend (see text 10c ). The generated information ist the basis for personalized newsletters, e.g. ordered catalogues and offers or bookings. Of course you may unsubscribe at any time free of charge using the unsubscribe button (in every newsletter).

3. Catalogue orders
You have the option to subscribe to our catalogues. through our website. The information you provide (salutation, name and surname, address, email; optional: title, telephone, fax) are exclusively used to send you the products you requested and are only disclosed when processing the request requires this (e.g. data processors). We are also happy to provide you with the latest edition. If you do not wish to receive any further post, you can revoke your consent to this at any time by sending an email to info@touristik.at

4. Booking
Your announced data will be only used from OÖ Touristik GmbH for the process of bookings and related transactions and will be passed on only in the context of the contractual relationship to third parties. (for example, tourist service providers, sights, passenger transport, processors)

Data storage
Please note, for easier checkout and future processing of contracts through the booking system operator, cookies are used to store the subscriber’s IP data along with the name, address and, if applicable, the buyer’s travelling companions.
Furthermore, we store the following data for the purpose of processing the contract: First and last name, travelling companions, address, email address, telephone number and, if applicable, fax number. To provide certain additional services and document discounts, the date of birth and body height may also be stored.

The data you provided is required to fulfil the contract or to take precontractual measures. Without this data, we are unable to conclude the contract with you.
If the purchase contract is not concluded with legal effect, the system will permanently delete this data.

The information you provide will be processed by OÖ Touristik GmbH to complete your reservations and related processes and only be disclosed to third parties (e.g. tourism services, data processing companies) within the scope of the contractual relationship.

Credit card data will be transmitted to the processing financial institutions / payment service provider to debit the purchase price.

In the event a contract is concluded, all data related to the contractual relationship will be stored until the retention period under tax law (7 years) has expired.
Data is processed based on the legal provisions of § 96 sec. 3 of the German Act on Telecommunications (TKG) and art 6 sec. 1 lit a (consent) and/or lit b (required for performance of contract) of the GDPR.

6. Sending rating reminders via email

Rating reminder through Trusted Shops
With your express consent pursuant to art. 6 sec. 1 sentence 1 lit a of the GDPR granted while or after placing your order, we will disclose your email address to Trusted Shops GmbH, Subbelrather Str. 15c, 50823 Cologne (www.trustedshops.de ), so they can send you a rating reminder via email.

This consent can be revoked at any time be sending a notice to the contact person listed below or by contacting Trusted Shops directly.

7. Disclosure of data
Your data are only disclosed if you have granted your consent to this or where this is necessary to fulfil a contract (e.g. to a data processor).

8. Cookies
Our website and emails (e.g. newsletter) use so-called cookies. These are small text files your browser installs on your device. Cookies allow us to make our services more user-friendly and tailor our email communication to your personal interests. The name, email address and areas of interest of subscribers of email newsletters are specifically stored and processed for this purpose. Furthermore, cookies allow us to recognise your browser the next time you visit our website. Cookies are not harmful and remain on your device until deleted.

9.  Web-Analyse-Tools
a) Google Analytics

This website uses Google Analytics, a web analysis service provided by Google, Inc. ("Google"). Google Analytics uses cookies, which are text files that are stored on your computer to help analyse usage. The information generated by cookies about your use of this website (e.g. IP address, access, navigation flow, length of visit, browsers and terminals used, language and country) is transferred to a Google server in the US and stored there. We, as the owner of this website, are entitled to analyse the usage of our webseite to make it for you as a user, as user-friendly as possible and improve it even further, for the most efficient development.

However, because IP anonymisation is activated ("_anonymizeIp()" function), your IP address will first be truncated by Google within the Member States of the European Union or in other signatory states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the US and truncated there. b) Other web analysis tools

Our website uses the functions of various web analysis tools such as Webalizer, AW-Stats, which use log files and are in part under GPL (General Public License). Cookies are used for this purpose, which allow the analysis of how users use the website. The information generated is transmitted to our server, where it is stored.  
You can prevent this by configuring your browser to block cookies.
We use these tools for marketing and optimisation purposes, particularly to allow us to analyse the use of our website and continuously improve functions and services based on this, and the user experience. Statistical analysis of user behaviour allows us to improve our services and make them more attractive to you as a user. This is also the basis for our legitimate interest in processing the above data.
The data collected (e.g. IP address) is stored and processed in pseudonymised or anonymised form.
Data is processed based on the legal provisions of § 96 sec. 3 of the German Act on Telecommunications (TKG) as well as art. 6 sec. 1 lit a (consent) and/or f (legitimate interest) of the GDPR.

c) Web-Extend
The website we operate uses the Web Extend data collection script of an e-marketing system. This is done by using cookies, which allow the analysis of how our website is used. We use the information generated to make our email communications as interesting as possible for you. The information is transmitted to the server of the service provider, where it is stored. If you do not agree with this use, please disable this function in your browser. Please note, this can limit the functionality of the website. The service provider processes your personal data based on the respective data processing contract.

10. Retention period
Your data are generally stored until the contractual relationship is terminated and/or pursuant to the statutory retention and limitation periods.

11. Google AdWords Remarketing
We use Google AdWords to advertise this website in the Google search results and on third-party websites. When visiting our website, Google will therefore install the so-called remarketing cookie, which automatically allows interest-based advertising through a pseudonymous cookie ID and based on your browsing history. This is used to protect our legitimate interests in the optimal marketing of our website, which prevails in the context of weighing interests pursuant to art. 6 sec. 1 sentence 1 lit f of the GDPR. If the purpose no longer applies and we no longer use Google AdWords remarketing, the data collected in this context will be deleted.

The data will only be processed further if you consented to Google linking your web and app browser history to your Google account and information from your Google account is used to customise advertisements you see on the Internet. In this case, if you are logged into Google when visiting our website, Google will use your data along with Google Analytics data to generate and define target group lists for remarketing across devices. Your personal data will then be temporarily linked with Google Analytics data by Google, to generate target groups.

Google AdWords Remarketing is a service provided by Google LLC (www.google.de). Google LLC has its headquarters in the USA and is certified under the EU-US Privacy Shield. You can see the current certificate here. Based on this framework between the USA and the European Commission the latter established an appropriate level of data protection for Privacy Shield certified companies.

12. Social Media
This website uses external links to the social media network Facebook and Instagram, which you can recognise by the respective logos.

The website does not use plugins for these social media networks and therefore, does not transmit user data to these.

12.1. Facebook, Custom Audiences and Facebook Marketing services
12.1.1. Based on our legitimate interest in analysing, optimising and operating our online services in a cost-effective manner and for these purposes, our online service uses the so-called “Facebook Pixel” provided by the Facebook social media network, operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or if you reside within the EU, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, (“Facebook”).
12.1.2. Facebook is certified under the Privacy Shield agreement and therefore, guarantees to comply with European data protection law. (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).
12.1.3. Using Facebook Pixel, Facebook can, on the one hand, identify visitors to our website as a target group for displaying advertisements (so-called “Facebook Ads”). Accordingly, we use Facebook Pixel to only show our Facebook Ads to those Facebook users, who have shown an interest in our online services or with specific characteristics (e.g. interest in specific topics or products identified by browser history), which we transmit to Facebook (so-called “Custom Audiences”). Moreover, we use Facebook Pixel to ensure our Facebook Ads meet the potential interest of users and are not annoying. With the help of Facebook Pixels we can also track the effectiveness of Facebook advertising for statistical and market research purposes by being able to identify whether or not users were redirected to our website after clicking on a Facebook advertisement (so-called “conversion”).
12.1.4. Facebook processes the data based on the Facebook privacy policy.
